TERMS AND CONDITIONS OF USE

User Provisions


ASSEMBLR EDU's products and services are provided by PT. ASSEMBLR TEKNOLOGI INDONESIA, which is based in Indonesia, and its affiliates Assemblr Pte Ltd (Singapore). These Terms of Service ("Terms") govern the access and use of the Assemblr website, products and services ("Products"). These Terms and Conditions govern you when accessing and using the application, the website (www.edu.assemblrworld.com and other websites we manage), features, technology, content and products we provide (hereinafter, collectively referred to as "Platform"). By accessing or using our Products, you agree to be bound by these Terms and by our Privacy Policy.


PLEASE READ THESE TERMS OF USE AND CONDITIONS CAREFULLY BEFORE USING OUR SITE.


By accessing or using this site, you agree to the terms of use, conditions and all applicable laws. If you do not agree to these terms, then you cannot use this site. Assemblr Edu in its sole discretion may change or revise the Terms of Service and this policy at any time, and you agree to be bound by these modifications or revisions. Nothing in these Terms of Service is considered giving rights or benefits to third parties.


General Terms

Assemblr Edu is happy to offer free services ("Free Services") with limited functionality, as well as various levels of paid services ("Paid Service" packages).


Assemblr EDU Account

To access some Service features, you must create an Assemblr EDU Account. You cannot use another person's account without permission. When creating an account, you must provide accurate and complete information. You are responsible for activities which occur on your account, and you must protect your account password. You must notify Assemblr immediately of any breach of security or unauthorized use of your account and must immediately notify us of any changes to the information you provided when registering by updating your personal information so that we can communicate with you effectively.


Although Assemblr will not be held responsible for losses caused by unauthorized use of your account, you may be responsible for losses from Assemblr or others due to such unauthorized use.


Assemblr EDU functions as a classroom, where users can choose the number of accounts used as needed and the plans available in Assemblr EDU. In usage of an Assemblr EDU account, the user can pass it on to someone else. For instance, the teacher who has access rights can give access rights to their students.

The security and confidentiality of your account, including registered name, registered e-mail address, registered mobile phone number, are entirely your personal responsibility. All losses and risks arising from your negligence in maintaining security and confidentiality as stated are borne by you and/or your parents, guardians or supervisors (if you are under 18 (eighteen) years). As such, we will regard any use made through your account as a legitimate request from you. You should immediately notify us if you know or suspect that your account has been used without your knowledge and consent. We will take actions that we deem necessary and can be carried out against the use without that agreement.


Minors

You represent and warrant that you are over 18 years of age or, if you are over 13 and under 18 years old, you are a released child, or have parental or legal guardian consent, and are fully capable and competent to obey and comply the terms, conditions, obligations, affirmations, statements and guarantees set forth in this Agreement. This provision does not apply if it is prohibited by law and the access rights to the Service is revoked in that jurisdiction.


Children and Our Service


While our Products are aimed to be used by children of varying ages, some of our Service (including our Sites) are intended to be used only by parents, legal guardians and/or teachers over the age of 18 (or age of majority relating to contracts in your jurisdiction).

In order to access certain features of our Service and to post any User Content (as defined below) on or through our Service, a person must register to create an account (“Account”) on the website:  Assemblr Edu reserves the right to suspend or terminate your Account if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete. It is your responsibility not to disclose your Account credentials to anyone. You will immediately notify Assemblr Edu of any unauthorized use of your Account.

In accordance with Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will never knowingly solicit, nor will we accept, personally identifiable information from users known to be under 13 years of age.

If a school and/or teacher (the “Educational Institution”) with students that are under 18 years of age uses our Service and provides us with personally identifiable information about its students in order to create user profiles for each of its students, such teacher must first obtain written consent from each student’s parent and/or legal guardian to submit such personally identifiable information to us and use such personally identifiable information in our Service. We use that information to provide our Service to the Educational Institution, consistent with our Privacy Policy. Each Educational Institution acknowledges and agrees that it will not use our Service in any way to collect personally identifiable information from users known to be under 13 years of age.


Ferpa


Student records obtained by Assemblr Edu from an educational institution continue to be the property of and under the control of the educational institution. The educational institution retains full ownership rights to the “Personal Information” and education records it provides to Assemblr Edu.


GDPR

Assemblr Edu only collects personal information through the Services from a student where their school, district, and/or teacher has agreed (via the terms described in more detail below) to obtain parental consent to use the Services and disclose personal information to us for the use and benefit of the learning environment. Such consent shall not be deemed as consent pursuant to GDPR.


Platform Usability and Limitation on using "Education Plans"


Assemblr Edu is used for personal use for free as well as made for classroom needs as stated in "Education Plans".

ASSEMBLR CERTIFIED EDUCATOR


Assemblr Certified Educator (ACE) is an ambassador of Assemblr EDU who is chosen based on the test results conducted by Assemblr EDU internal team.


In order to apply to Assemblr Certified Educator (ACE), the applicant must fill in the test form through the registration page provided at https://edu.assemblrworld.com/. On the form, an ACE applicant will be given list of questions by Assemblr EDU internal team to determine whether the applicant is eligible for the ACE program. Assemblr EDU internal team will confirm their results via e-mail address listed upon registration. If the completion of the task list provided by Assemblr EDU shows result that matches our qualifications, the ACE applicant will get a certificate when reaching level 1 that will be given no later than 3 (three) working days after the ACE candidate sends the results of the task list we provided.


Assemblr Certified Educator (ACE) has the privilege of being granted an ACE certificate for no time limit, being a member of ACE mailing list and getting the latest newsletter for every Assemblr EDU update, getting exclusive tutorials, getting exclusive educational content material (education bundle) from Assemblr EDU which facilitates their teaching activities.


ACE license is only granted to ACE and does not authorize ACE to pass it to other parties. This also applies to the privileges granted to ACE in the form of information provided by the Assemblr EDU. Any form of exclusive content materials, booklets, education bundles, exclusive tutorials and other tools that we have given are not allowed to be distributed without prior permission from Assemblr EDU.

Assemblr has a strong commitment to maintaining your privacy. Please review Assemblr EDU’s Privacy Policy.


Restriction of Use of Assemblr EDU


You cannot use the Service for illegal or unauthorized purposes. You agree to comply with all laws, rules and regulations that apply to the use of your Services and Content (defined below), including but not limited to copyright protection and other intellectual property rights.


You are responsible for your behavior towards data, text, files, information, usernames, images, graphics, photos, profiles, audio and video, sound, musical works, authorship works, applications, links and other content or material (collectively, "Contents") that you submit, post or display on or through the Service.


Assemblr EDU will facilitate users to download educational 3D assets that we have provided and modify 3D images of these assets. Assemblr EDU users agree that the copyright on the assets downloaded is permanent property of Assemblr EDU.


It is not allowed:


to upload, post or transmit any material that is obscene, offensive, blasphemous, pornographic, illegal, threatening, abusive, dangerous, violates the right to privacy or publicity, defames, defames, vulgar, illegal or inappropriate;


to upload, post or transmit any material that violates copyright, trademark, patent or other intellectual property rights or moral rights or any rights of third parties including, but not limited to facilitating illegal distribution of copyrighted content or illegal content;


to endanger minors in any way, including, but not limited to, uploading, posting or transmitting content that violates child pornography laws, laws or regulations on sexual exploitation of children which prohibit the depiction of minors involved in sexual behavior, or sharing any personally identifiable information about any child under the age of 13;


falsifying or manipulating identifiers to disguise the origin of the Content sent through our Services;


uploading, posting or transmitting any material that is likely to cause damage to the Assemblr EDU computer system or anyone, including injecting viruses, codes, worms, data or other files or programs that are designed to damage or allow unauthorized access to the Services that can cause defects, errors or malfunctions with services.


License


Our Terms and Policies (including our Acceptable Use Policy) grant you a limited, non-exclusive, non-transferable, and revocable license to use our Products.


Copyright


Assemblr is the owner of all copyrights and data rights in the Services and its Contents. Individuals who have posted their work to Assemblr will be the copyright owners of the component parts of the work, or post the work under a license from the copyright owner or agent or vice versa as permitted by law. You may not reproduce, distribute, display or perform publicly, or prepare derivative works based on any Content including any work without written consent from Assemblr or the appropriate copyright owner in the works. Assemblr does not claim ownership rights in your work or other material posted by you to Assemblr (Your Content). You agree not to distribute any part of the Service other than your Content in any media other than as permitted in these Terms of Service or by using functions on the Service provided by us. You agree not to change or modify any part of the Service unless it is expressly permitted to do so by us or by using functions on the Service provided by us.


Copyright in Content


Assemblr does not claim ownership rights in your Content. You grant Assemblr a non-exclusive, royalty-free license to reproduce, distribute, reformat, store, prepare derivative works based on, and publicly display and perform your Content. Please note that when you upload Content, third parties will be able to copy, distribute and display your Content using tools available on their computers for this purpose, even if other than linking to your Content on Assemblr used by the third parties, they may violate paragraph 9 of these Terms and Conditions unless third parties receive permission from you with a license.


Third Party Links On Assemblr EDU Platforms


Our Platform contains links and access to websites and other contents provided by third parties. We have no control over the content of these websites or resources. We are not responsible for any part of the content provided by third parties. Your access or use of third party content is a form of your agreement to comply with the Terms and Conditions and privacy policy set forth by the Third Party.


Reporting Violations of Intellectual Property Rights

Assemblr EDU respects the intellectual property rights of others, and we ask our users and visitors to do the same. Assemblr EDU will process and investigate suspected violations and will take action based on applicable intellectual property laws. After receiving notification in accordance with applicable rules, Assemblr EDU will act to remove or deactivate access to material found to be infringing or to be subject to infringing activity, and will act to remove or disable access to references or links to material or activities found to have been violated.


If you feel that your work has been copied in a way that violates copyright or other intellectual property rights, please provide Assemblr EDU the following information. Please note that in order to act effectively, your notice must include the following: physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive copyright that is allegedly infringed; a description of the copyrighted work that you claim has been infringed; a description of the location of the material that is considered infringed on the site; address, telephone number, and e-mail address along with all other information that can make Assemblr EDU team contact you; a statement that you have a good faith belief that the material that is claimed as copyright infringement is not authorized by the copyright owner, its agent, or the law; a statement that you make, made under oath, that the information in your Notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Monitoring Contents


Assemblr EDU does not have the ability to control the Content that you can upload, post or send using the Service and has no obligation to monitor the Content for any purpose. You acknowledge that you are fully responsible for all Content and material that you upload, post or transmit using the Service.


Behavior


You agree that you may not interfere with (or attempt to interfere with) this Service or the server or network connected to this Service, or not to comply with all network requirements, procedures, policies or regulations connected to this Service, or provide any false or misleading information to Assemblr, trying to hide your identity. You agree to defend, indemnify and hold Assemblr free from third party claims for wrongdoing (freeing directors, employees and agents, from and against claims, obligations, damages, losses and expenses, including, but not limited to, legal fees arising out of or in any way related to your violation of these Terms).


Compensation


To the extent permitted by applicable law, you agree to indemnify and protect the Assemblr EDU from harm and against any damage, loss and any costs (including attorneys' fees and expenses) arising from: (1) violations of the Agreement made by you; (2) User Content; (3) any activity in which you are involved in or through the Assemblr Service; and (4) violations of law or third party rights committed by you.


Ownership


All Assemblr EDU Content is owned by PT. Assemblr Teknologi Indonesia and its affiliates are protected by the laws of the Republic of Indonesia and international copyright laws, trademark laws, industrial designs, patents and/or other rights and property rights laws that apply in Indonesia and as a part of regulated in WIPO (World Intellectual Property Organization) regulations. Your use of the Service does not give you any ownership in Assemblr EDU Content and except for the limited license we give you under this Agreement, your use of the Service does not give you any license or permission under copyright, trademark or intellectual property the other. property rights of Assemblr or its affiliates. We have all rights not expressly granted to you in this Agreement.


Retention Policy


Currently, Assemblr EDU provides free and paid online storage of your Content on our service. However, you acknowledge and agree that the Assemblr EDU establishes restrictions regarding use of the Service, including the maximum number of days that your Content will be stored by the Service, the maximum size of each Content file that may be stored on the Service, the maximum disk space that will be given to you for storage of Content on the Assemblr EDU server. In addition, you acknowledge that Assemblr EDU has the right to terminate or suspend inactive accounts, in the sole discretion of Assemblr EDU, for a long period of time (thereby removing or suspending access to your Content). Assemblr EDU will not be responsible or liable for the deletion or failure to store any Content retained on the Service and you are fully responsible for backing up your Content. You further acknowledge that Assemblr Edu has the right to change its retention policy from time to time, with or without notice to you.


Force Majeure (FORCE MAJEURE)


Our Platform may be interrupted by events outside of our authority or control ("Force Majeure"), including but not limited to natural disasters, power disruptions, telecommunications disruptions, government policies, and others. You agree to release us from any demands and responsibilities, if we are unable to facilitate the service, including fulfilling the instructions you provide through the Platform, either in part or in full, due to a Force Majeure.


Applicable Law and Jurisdiction


This provision is governed by the laws of the Republic of Indonesia, without conflicting with legal principles. Each of us agrees to submit to the jurisdiction chosen for each resolution / dispute.


Any claim or dispute between you and Assemblr EDU which arises in whole or in part from the Service will be decided exclusively by a court of competent jurisdiction located in the Republic of Indonesia.


For each of your disputes with Assemblr EDU, you agree to first contact us and try to resolve the dispute with us informally. If you have not been able to settle a dispute with us informally, we each agree to settle claims, disputes or controversies (not including claims for compensation or other equivalent compensation) arising from or relating to these Terms under the law of Republic of Indonesia as specified in this service.


Warranties and Limitation of Liability


The Platforms that we provide are as they are and we do not represent or guarantee that the reliability, timeliness, quality, suitability, availability, accuracy, completeness or security of the Platform can meet your needs and will meet your expectations.


We are not responsible to any user for loss or damage, whether in the form of contracts, unlawful acts (including negligence), breaches of obligations under the law, or vice versa, although predictable, which occurs under or related to:


Use of, or the inability to use, Our Platform; or

Use or trust in any content displayed on Our Platform.


We only provide a Platform for domestic and personal use. You agree not to use our Platform for any commercial or business purpose, and we are not responsible to you for loss, loss of business, business interruption or loss of business opportunity.


We are not responsible for losses or damage caused by viruses, Distributed Denial of Service (DDoS) attacks, or other dangerous technology material that can infect computer equipment, computer programs, data, or other proprietary material due to the use or downloading of any content from our Platform and other websites related to it by you.


We have no obligation to monitor your access or use of the Platform. However, we will continue to supervise to ensure the smooth use of the Platform and to ensure your compliance with these Terms and Conditions, applicable laws and regulations, court rulings, and/or other administrative or government agency requirements.


We are not responsible for the content of websites linked to our platform. Such links should not be interpreted as a form of our support for these sites. We are not responsible for any loss or damage arising from your use of these websites.


Other Provisions


This agreement, together with the Privacy Policy, represents the entire agreement between the Assemblr EDU and the User regarding the provision of the Service, and all prior representations and understandings, both written and oral. You cannot transfer this Agreement or any rights or obligations here to any third party. Assemblr EDU may freely stipulate this Agreement, including for the development of its business operations. You agree that the electronic text of this Agreement is written, and your agreement to the Terms and Conditions of this agreement constitutes "signing" for all purposes. You agree to receive communications from us electronically, and you agree that we can communicate with you via e-mail or by posting a notice on the Service. You agree that all agreements, notices, disclosures and other communications that we provide to you, or that you provide to us, electronically fulfil all legal requirements that require that communication be made in writing.
