The effective date of these Terms of Use Assemblr Edu is 16 August 2024.

User Provisions

Assemblr EDU's products and services are provided by PT. Assemblr Teknologi Indonesia, based in Indonesia. These Terms of Service ("Terms") govern the access and use of the Assemblr website, products, and services ("Products"). By accessing or using our Products, you agree to be bound by these Terms and by our Privacy Policy.

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING OUR SITE.

By accessing or using this site, you agree to the terms of use, conditions, and all applicable laws. Assemblr EDU may change or revise the Terms of Service and this policy at any time, and you agree to be bound by these modifications or revisions. Nothing in these Terms of Service grants rights or benefits to third parties.

You are responsible for maintaining the security and privacy of your account, including your registered name, e-mail address, and mobile phone number. Any damages or risks resulting from your negligence in maintaining account security and privacy as mentioned here will be borne by you and/or parents, guardians (if you’re under 18 (eighteen) years old). Assemblr EDU considers all actions taken on your account as authorized by you. If you suspect unauthorized use of your account, please notify us immediately so we can take preventive action.

Modifications

Assemblr reserves the right to modify the website, services, and this policy at any time without prior notice. We will post any modifications on our website or inform you directly. Continuing to access or use our website or services after modifications are posted constitutes your acceptance of the revised terms.

Application Uses and Services

Your access and use of the Application must comply with these Terms and Conditions.

You have the right to use or stop using the Application and its services at any time.

If you are a government employee or state administrator, you agree to comply with provisions of the legislation, especially that organizes acceptance of gratuities, as well as other provisions that are in effect on your institution.

If you are a teacher or an education staff, you agree to comply with provisions of legislation regarding the management and maintenance of education, especially when it’s related to social activities, marketing, distribution, or program or product.

Assemblr Account

To access some service features, you must create an Assemblr Account. You cannot use another person's account without permission. When creating an account, you must provide accurate and complete information. You are responsible for all activities on your account and must protect your password. Notify Assemblr immediately of any security breaches or unauthorized use of your account and update your personal information as needed.

Assemblr functions as a classroom, allowing users to choose the number of accounts needed. Teachers can delegate access rights to students. The security and confidentiality of your account are your responsibility. Assemblr will regard any actions taken through your account as legitimate unless you notify us of unauthorized use.

Account Limitations

Your Assemblr account is limited to use on two (2) different devices/browsers simultaneously. If you exceed this limit, you will receive a notification and need to log out on the other device to use the existing device. If Assemblr suspects fraudulent activity or other violations of these Terms, it may suspend or terminate your account.

Minors

You represent and warrant that you are over 18 years of age, or if you are between 7 years old and under 18 years old, you have parental or legal guardian consent to use the Services. This provision does not apply if it is prohibited by law and the access rights to the Service is revoked in that jurisdiction.

Pricing and Payment

The Assemblr app is free to use. However, certain services or features are subject to subscription fees. Subscription pricing and payment methods are detailed within the Application. We reserve the right to change or update subscription pricing based on factors such as service type and applicable laws.

Payments can be made using various methods provided by third parties, including electronic payments, debit/credit cards, bank transfers, etc. Assemblr is not responsible for errors or downtime caused by payment service providers. We may refuse or delay payment requests in cases of suspected fraud, legal violations, or other suspicious activities.

Interactive Services

Assemblr may provide interactive services within the Application. Details about these services will be provided as they become available. Parents or guardians must supervise users under 18 when using interactive services. Parents should understand the potential risks and be fully responsible for their children's actions when using these services.

Children and Our Service

While Assemblr EDU products are designed for children, certain services are intended for use only by parents, legal guardians, or teachers over the age of 18. To access specific features and post User Content, an account must be created. Assemblr reserves the right to suspend or terminate accounts with inaccurate or incomplete information.

In compliance with the Federal Children's Online Privacy Protection Act (COPPA), Assemblr will not knowingly collect personal information from users under 13. Schools or teachers using our Services must obtain written consent from parents or guardians before submitting any personal information about students.

GDPR

Assemblr Edu only collects personal information through the Services from a student where their school, district, and/or teacher has agreed (via the terms described in more detail below) to obtain parental consent to use the Services and disclose personal information to us for the use and benefit of the learning environment. Such consent shall not be deemed as consent pursuant to GDPR.

Assemblr Certified Educator (ACE)

Assemblr Certified Educators (ACE) are selected based on test results conducted by the Assemblr EDU team. Applicants must complete a registration form and meet qualification criteria to receive ACE certification. Certified Educators enjoy privileges, including access to exclusive content and updates.

ACE certification is non-transferable, and exclusive materials provided to ACEs may not be distributed without permission from Assemblr EDU.

Assemblr is committed to maintaining your privacy. Please review the Assemblr EDU Privacy Policy for more details.

Restrictions on Use of Assemblr EDU

You may not use the Service for illegal or unauthorized purposes. You agree to comply with all laws and regulations related to your use of the Services and Content.

You are responsible for any data, text, files, information, usernames, images, graphics, photos, profiles, audio, video, sound, musical works, applications, links, and other content you submit, post, or display through the Service.

Assemblr EDU provides users with the ability to utilize 3D assets and other elements to create their own interactive content. Users agree that the copyright for these assets remains with Assemblr EDU and its partner (if applicable).

It is prohibited to:

  • Upload, post, or transmit any material that is obscene, offensive, illegal, or inappropriate.
  • Violate copyright, trademark, or other intellectual property rights.
  • Endanger minors or violate child protection laws.
  • Falsify or manipulate identifiers to disguise the origin of Content.
  • Upload, post, or transmit material designed to damage Assemblr EDU’s systems.

Rules for Duplicating Projects

  • When publishing a project, users can set it to be either public or private (viewable only by those granted access). Users can also specify whether the project can be duplicated by others.
  • Projects set to be duplicatable will display a "Duplicate this project" button on the project's page, allowing other users to copy the project.
  • When a project is duplicated, the original owner's name and a history of the users who have copied the project will be displayed.
  • The origin ownership of the project is stated in the history of the ownership of the project. It shows who duplicated the project from whom and identifies the original owner of the project.

License

Assemblr grants you a limited, non-exclusive, non-transferable, and revocable license to use its Products under these Terms.

Intellectual Property Rights

All elements contained in this platform, including but not limited to software, source code, trademarks/service marks, graphic designs, 3D models, animations, text, images, audio, video, and all Intellectual Property Rights generated by Assemblr , is the property of Assemblr and protected by law.

Copyright

Assemblr owns all copyrights and data rights in the Services and Content. Users retain ownership of their work but grant Assemblr a non-exclusive, royalty-free license to reproduce, distribute, reformat, store, prepare derivative works based on, and publicly display and perform their Content. Assemblr does not claim ownership rights in your Content. Please note that when you upload Content, third parties will be able to copy, distribute, and display your Content using tools available on their computers for this purpose, even if other than linking to your Content on Assemblr used by the third parties, they may violate clausule Licence of these Terms and Conditions unless third parties receive permission from you with a license.

Third-Party Links on Assemblr EDU Platforms

Our Platform may contain links to third-party websites and content. Assemblr is not responsible for the content provided by third parties. Your use of third-party content is subject to the terms and conditions set by those parties.

Reporting Violations of Intellectual Property Rights

Assemblr EDU respects intellectual property rights and will take action against suspected violations. If you believe your work has been infringed, please provide the necessary information to Assemblr EDU.

If you feel that your work has been copied in a way that violates copyright or other intellectual property rights, please provide Assemblr EDU the following information. Please note that in order to act effectively, your notice must include the following: physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive copyright that is allegedly infringed; a description of the copyrighted work that you claim has been infringed; a description of the location of the material that is considered infringed on the site; address, telephone number, and e-mail address along with all other information that can make Assemblr EDU team contact you; a statement that you have a good faith belief that the material that is claimed as copyright infringement is not authorized by the copyright owner, its agent, or the law; a statement that you make, made under oath, that the information in your Notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Monitoring Content

Assemblr EDU does not monitor all content uploaded, posted, or transmitted through the Service. Users are fully responsible for their content and materials.

Behavior

You agree that you may not interfere with (or attempt to interfere with) this Service or the server or network connected to this Service, or not to comply with all network requirements, procedures, policies or regulations connected to this Service, or provide any false or misleading information to Assemblr, trying to hide your identity. You agree to defend, indemnify and hold Assemblr free from third party claims for wrongdoing (freeing directors, employees and agents, from and against claims, obligations, damages, losses and expenses, including, but not limited to, legal fees arising out of or in any way related to your violation of these Terms).

Compensation

To the extent permitted by law, you agree to indemnify Assemblr EDU from any damage, loss, or costs arising from your violation of the Agreement, User Content, or any activity involving the Assemblr Service.

Ownership

All Assemblr EDU Content is the property of Assemblr unless otherwise stated. Users may not reproduce, distribute, display, or create derivative works based on the Content without written consent from Assemblr.

Retention Policy

Currently, Assemblr EDU provides free and paid online storage of your Content on our service. However, you acknowledge and agree that the Assemblr EDU establishes restrictions regarding use of the Service, including the maximum number of days that your Content will be stored by the Service, the maximum size of each Content file that may be stored on the Service, the maximum disk space that will be given to you for storage of Content on the Assemblr EDU server. In addition, you acknowledge that Assemblr EDU has the right to terminate or suspend inactive accounts, in the sole discretion of Assemblr EDU, for a long period of time (thereby removing or suspending access to your Content). Assemblr EDU will not be responsible or liable for the deletion or failure to store any Content retained on the Service and you are fully responsible for backing up your Content. You further acknowledge that Assemblr Edu has the right to change its retention policy from time to time, with or without notice to you.

Force Majeure (FORCE MAJEURE)

Our Platform may be interrupted by events outside of our authority or control ("Force Majeure"), including but not limited to natural disasters, power disruptions, telecommunications disruptions, government policies, and others. You agree to release us from any demands and responsibilities, if we are unable to facilitate the service, including fulfilling the instructions you provide through the Platform, either in part or in full, due to a Force Majeure.

Applicable Law and Jurisdiction

This provision is governed by the laws of the Republic of Indonesia, without conflicting with legal principles. Each of us agrees to submit to the jurisdiction chosen for each resolution / dispute.

Any claim or dispute between you and Assemblr EDU which arises in whole or in part from the Service will be decided exclusively by a court of competent jurisdiction located in the Republic of Indonesia.

For each of your disputes with Assemblr EDU, you agree to first contact us and try to resolve the dispute with us informally. If you have not been able to settle a dispute with us informally, we each agree to settle claims, disputes or controversies (not including claims for compensation or other equivalent compensation) arising from or relating to these Terms under the law of Republic of Indonesia as specified in this service.

Warranties and Limitation of Liability

The Platforms that we provide are as they are and we do not represent or guarantee that the reliability, timeliness, quality, suitability, availability, accuracy, completeness or security of the Platform can meet your needs and will meet your expectations.

We are not responsible to any user for loss or damage, whether in the form of contracts, unlawful acts (including negligence), breaches of obligations under the law, or vice versa, although predictable, which occurs under or related to:

  • Use of, or the inability to use, Our Platform; or
  • Use or trust in any content displayed on Our Platform.

Our Platforms can undergo any limitation, delay, and other problems out of our control. We are not responsible for any lateness, sending failure, damage, loss, or disadvantages caused by the issues mentioned above or other issues that we are not capable of controlling. However, we will always try our best to help you.

We only provide a Platform for domestic and personal use. You agree not to use our Platform for any commercial or business purpose, and we are not responsible to you for loss, loss of business, business interruption or loss of business opportunity.

We are not responsible for losses or damage caused by viruses, Distributed Denial of Service (DDoS) attacks, or other dangerous technology material that can infect computer equipment, computer programs, data, or other proprietary material due to the use or downloading of any content from our Platform and other websites related to it by you.

We have no obligation to monitor your access or use of the Platform. However, we will continue to supervise to ensure the smooth use of the Platform and to ensure your compliance with these Terms and Conditions, applicable laws and regulations, court rulings, and/or other administrative or government agency requirements.

We are not responsible for the content of websites linked to our platform. Such links should not be interpreted as a form of our support for these sites. We are not responsible for any loss or damage arising from your use of these websites.

Others

This agreement, together with the Privacy Policy, represents the entire agreement between the Assemblr EDU and the User regarding the provision of the Service, and all prior representations and understandings, both written and oral. 

You cannot transfer this Agreement or any rights or obligations here to any third party. Assemblr EDU may freely stipulate this Agreement, including for the development of its business operations. 

You agree that any electronic text of these Terms is a form of document, and by agreeing to the Terms and Conditions, you will “sign” to all the points as a form of agreement. You will also free Assemblr from any legal claims for using Assemblr platforms. You agree that the electronic text of this Agreement is written, and your agreement to the Terms and Conditions of this agreement constitutes "signing" for all purposes. 

You agree to receive communications from us electronically, and you agree that we can communicate with you via e-mail or by posting a notice on the Service. You agree that all agreements, notices, disclosures and other communications that we provide to you, or that you provide to us, electronically fulfil all legal requirements that require that communication be made in writing.
